應報觀點的核心在於，國家有必要用刑罰回應一個與其價值程度相對應、出自主體意志決定的犯罪行為。應報理論之證立，因而必須先肯定個人的主體性，論證國家與主體負擔的義務關聯性，並說明現實上刑罰與犯罪的對應合理性。本課程將以最近英美法上的學說觀點討論應報理論的正當性基礎。另外，本學期課程將安排1-2次專題演講。 |
能力項目說明
本課程旨在讓同學從第一手文獻資料切入，理解Jeremy Waldron 的“Lex Talionis”、Matthew Kramer所提出的翦除論（purgative rationale）及R.A. Duff的溝通應報論理論的內涵，並進行關於刑罰目的與正當性的思考。

上課主要將以閱讀文獻、及分組針對文獻進行報告與討論形式進行，教師則會在導論及學期結束前進行綜合性引導與總結。口頭報告時同學應先完成書面報告初稿，並於報告前至少三日將報告檔案上傳給修課同學參考。成績的評量以書面整理及報告撰寫、口頭報告以及對他人報告之評論、參與課堂討論的綜合表現為基礎。
