課程簡介Course Description

二十世紀屬大眾媒體(印刷、電子)世紀,不論產製、使用者、管制文獻頗多,世紀末,網路興起,匯流紀元到來,技術演進衝擊法規與使用者,電信與媒體匯流,平台經濟興起,疫情其間資訊、娛樂、社交、商業均仰賴平台,近來人工智慧的推陳出新更讓規管機關忙得很。本課程將簡單討論傳統媒體的規管(或稱管制,regulation),重點放在匯流衝擊的政策與法規議題,以及各國隨之因應的規管思維、法規等。

  政策、法規過去當然歸屬國家職掌,於今網路全球化,歐盟政策(EU communication policies)最清楚,也走在最前面;美國過去在新自由主義氛圍下,除強調言論自由外,並無上位的傳播政策,然近年受地緣政治等多種因素的影響,美國國會一些積極的議員就想立法來處理假新聞、平台壟斷、兒少網路成癮等議題。我國則介於管與不管之間,NCC 2022年六月提出數位中介服務法草案,反彈過大收回。數位發展部成立,資安、國安、新聞議價、打詐等都很熱,看看他國、想想自己,課堂上均將討論。

  本課程從傳統媒體的規管開始(content regulation, structural regulation),重心將放在全球化、數位化下的傳播政策與重要法規,比例上,法規三分之一,政策約三分之二,國內題材三分之一,國際則佔三分之二。

    1. 介紹傳統媒介法規與政策的相關理論與規管重點:內容規約、結構規約、規管機關。
    2. 各國(美國、歐盟、英國、中國、台灣)媒體政策與匯流後的轉變。
    3. 平台責任(自律、共管)、媒體素養、人工智慧法案。
       

    學生修習本課後,可以:

    1. 熟知大眾媒體時代的媒介法規重點(言論自由、市場集中)。
    2. 掌握國際上對媒體、電信、匯流規管的重要議題(假新聞、數位服務法、共管、新聞議價法)。
    3. 關注我國數位匯流相關法規(OTT法、數位通訊傳播法)。
