以國際貿易為主要導向的經濟是我國的命脈。海上保險係因應國際貿易之運作需求而產生，是國際貿易之主要支柱之一，也是所有各種保險的起源，是所有保險的母法，Institute Cargo Clauses是全世界唯一統一的保險條款，也是聯合國貿易與發展會議（UNCTAD – United Nations Conference on Trade and Development）唯一建立模範條款，在國際社會中極為重要。國際貿易絕大部分貨物(百分之九十左右)是海運，因海運運量大運費低使商品較具有競爭力，而海上保險與海上運輸，國際金融一樣支撐國際貿易於國際貿易中具有關鍵的重要性。海上保險主要承保海上作業的風險，因此海上保險不僅涉及保險法的全部，亦涉及海事法的全部，不對保險法及海事法各個領域的規範有週全與深入之瞭解，無法深入瞭解海上保險法與實務。亦因此海上保險是保險法與海事法中最有趣最深奧與最困難之部份。猶記得一九八二年
負笈現代保險與海事法之起源地 － 英國倫敦進入倫敦大學深造，追隨英國保險與海事法泰斗Professor E. R. Hardy Ivamy深入學習保險與海事法最深奧之處，由倫敦大學歸來至今已三十餘年，我國保險法與海商法距離國際社會海上保險主流的法律規則與實務仍有相當大的空間可以共同努力予以改善。
Marine insurance is one of the framework of international trade and is the origin of all kinds of insurances which can be found in this world. It covers maritime perils and related perils in other fields.This insurance is operated with international documents,such as Institute Cargo Clauses,Institute Time Clauses-Hull,and is related to international reports adopted by United Nations Conference on Trade and Development.
能力項目說明
本課程將針對我國保險法與海商法「海上保險」章可能的困難，參考影響國際社會海上保險最深之英國海上保險實務作業與法律(聯合國貿易與發展會議稱英國法是海上保險事實上的國際法 ： de facto international law)，深入予以討論。海上保險部份亦受美國法的影響，故美國法影響海上保險部份亦將予以講授。
學生如碩士班學生較多，將教比較深，如大學部學生比較多，將教比較通常的深度。為兼顧大學部與碩士班學生，本課程主要教學方法是講授及課堂討論(師生互動教學)。
